Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Winny Speaking website, mobile app, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Service description
Winny Speaking provides a communication performance training platform. The Service includes:
- Recording and transcription of spoken practice sessions via audio captured on your device.
- AI-generated communication scores, coaching feedback, and performance analytics based on your session transcripts.
- Session history, progress tracking, and scenario-based practice prompts.
The Service is for personal educational and self-improvement use. It does not provide medical, legal, financial, or professional consulting advice. AI-generated feedback reflects pattern-based analysis and is not a substitute for qualified human coaching or advice.
4. Free tier and plan limits
A free tier of the Service is available subject to the following limitations, which may be updated from time to time:
- A limited number of practice sessions per month (displayed in-app).
- Access to core feedback categories only; advanced analytics are reserved for paid plans.
- Session history retained for a limited period on the free tier.
If you exceed free-tier limits, you may be prompted to upgrade or wait until the next billing period. Current limits are shown in the app at the time of use.
5. AI-generated content disclaimer
Scores, feedback, transcripts, and other outputs produced by the Service are generated by automated AI models. They are provided for informational and developmental purposes only. Winny Speaking does not warrant that AI-generated outputs are accurate, complete, or suitable for any particular purpose. You are solely responsible for how you interpret and act on AI-generated feedback.
6. Acceptable use
You agree not to:
- Misuse or attempt to circumvent service functionality or security controls.
- Upload or record content that is unlawful, harmful, harassing, defamatory, or infringes third-party rights.
- Record conversations involving third parties without their knowledge or consent, where required by applicable law.
- Use the Service to train or develop competing AI models or to systematically extract Service data.
- Attempt unauthorised access to our systems, accounts, or infrastructure.
7. User content
You retain ownership of audio recordings and other inputs you submit. You grant Winny Speaking a limited, non-exclusive, worldwide licence to process that content solely to operate and improve the Service features you use, consistent with our Privacy Policy. You represent that you have all necessary rights to submit the content you provide.
8. Account termination
By you: You may delete your account at any time via the in-app account settings or by emailing hi@winnyspeaking.com. Account deletion removes your personal data in accordance with our Privacy Policy retention schedule.
By us: We may suspend or terminate your access with or without notice if you violate these Terms, engage in fraudulent activity, or if continued access creates legal or security risk. If we terminate for reasons other than your breach, we will provide reasonable advance notice where practicable.
9. Subscriptions and purchases
Some features may be available on paid plans in the future. If paid iOS plans are offered, purchases, renewals, and refunds are processed under Apple App Store rules and billed through your Apple ID. We do not process full card data directly.
10. Third-party services
The Service integrates third-party providers including Google Cloud (Firebase), Apple, Google, and Microsoft identity services, Deepgram, AssemblyAI, Google Vertex AI, and xAI. Their respective terms and privacy policies apply to your interactions with those integrations. Winny Speaking is not responsible for third-party services.
11. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, or guaranteed outcomes from AI-generated feedback.
12. Limitation of liability
To the maximum extent permitted by applicable law, Winny Speaking EOOD shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business, arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) €50.
13. Indemnification
You agree to indemnify, defend, and hold harmless Winny Speaking EOOD and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you submit; or (c) your violation of any third-party right, including privacy or intellectual property rights.
14. Dispute resolution
We encourage you to contact us at hi@winnyspeaking.com first and allow 30 days for good-faith resolution before initiating formal proceedings. If a dispute cannot be resolved informally, it shall be submitted to the competent courts in Sofia, Bulgaria, unless mandatory consumer protection law in your country of residence requires otherwise.
15. Governing law
These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-law provisions, unless mandatory local consumer law requires otherwise.
16. Force majeure
Neither party is liable for delays or failures in performance caused by circumstances beyond their reasonable control, including acts of God, internet outages, infrastructure failures, government actions, or third-party provider outages.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and Winny Speaking EOOD regarding the Service and supersede all prior discussions or agreements.
19. Changes to service and terms
We may update service features and these Terms over time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by in-app or email notice. Continued use of the Service after the effective date of updates constitutes acceptance of the revised Terms.
